By accessing and using Dashspace, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Dashspace SASU ("Dashspace," "we," "us," or "our"), concerning your access to and use of the dashspace.space website as well as the app.dashspace.space application and any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Sites").

You agree that by accessing the Sites, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Sites and you must discontinue use immediately. Supplemental terms and conditions or documents that may be posted on the Sites from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason.

We will alert you about any changes by updating the "Last updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Service by your continued use of the Sites after the date such revised Terms are posted.

2. Description of Service

Dashspace provides comprehensive business intelligence and data science solutions through a sophisticated Software as a Service (SaaS) platform. Our services include but are not limited to data analysis tools, visualization capabilities, reporting features, and consultation services designed to help businesses make data-driven decisions. We offer our services through various subscription models, including monthly recurring subscriptions and one-time lifetime access packages, each designed to meet different user needs and preferences.

Our platform is designed for professional use and requires a certain level of technical understanding. While we strive to make our tools as user-friendly as possible, users should have basic knowledge of data concepts and business intelligence principles to fully benefit from our services. We provide documentation, tutorials, and customer support to help users maximize the value they receive from our platform.

3. User Registration and Accounts

To access certain features of the Sites, you must register for an account. When you register for an account, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. You also agree to promptly update your account information to keep it accurate, current, and complete. If we suspect that your account information is untrue, inaccurate, out-of-date, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of our services.

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these requirements. You may not use another person's account without permission from that person and us.

You must be at least 18 years old to use our services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Subscription Plans and Payment Terms

Subscription Options

We offer flexible subscription plans to accommodate different user needs and budgets. Our monthly subscription plans automatically renew each month unless cancelled, providing continuous access to our platform and regular updates. These subscriptions can be cancelled at any time, with access continuing until the end of the current billing period. Our lifetime access packages require a one-time payment and provide unlimited access to the platform for as long as the service exists, representing exceptional value for long-term users.

Pricing and Payment

All prices for our services are displayed in Euros (EUR) and include applicable taxes unless otherwise stated. We reserve the right to modify our pricing at any time, though any price changes will not affect active subscriptions until their next renewal period. For lifetime packages, the price at the time of purchase is final and will not be affected by future price changes.

Payment must be made through the payment methods we accept on our platform, which may include credit cards, debit cards, and other electronic payment methods. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided and that the information you provide is true and accurate. We use trusted third-party payment processors to handle all financial transactions, and we do not store complete payment card information on our servers.

Billing and Renewal

For monthly subscriptions, billing occurs automatically on the same day each month as your initial subscription date. If your payment method fails, we will attempt to process the payment again according to our retry schedule. Continued failure to process payment may result in suspension or termination of your account. We will send you email notifications about upcoming renewals and any payment issues that arise.

5. Refund and Cancellation Policy

Due to the digital nature of our services and the immediate access granted upon payment, we generally do not offer refunds once a subscription period has begun or a lifetime access package has been purchased. However, we understand that exceptional circumstances may arise, and we evaluate refund requests on a case-by-case basis at our sole discretion.

For monthly subscriptions, you may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will continue to have access to the service until that time. No partial refunds are provided for unused time within a billing period.

Lifetime access packages are non-refundable after purchase. We encourage users to try our monthly subscription first if they are unsure about committing to lifetime access. We may occasionally offer trial periods or money-back guarantees as part of promotional campaigns, and such offers will be clearly stated in the promotional materials.

6. Acceptable Use Policy

You agree to use our Sites and services only for lawful purposes and in accordance with these Terms. You agree not to use the Sites in any way that violates any applicable federal, state, local, or international law or regulation. You also agree not to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

You further agree not to: (a) use the Sites in any manner that could disable, overburden, damage, or impair the Sites or interfere with any other party's use of the Sites; (b) use any robot, spider, or other automatic device, process, or means to access the Sites for any purpose; (c) introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful; (d) attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Sites, the server on which the Sites are stored, or any server, computer, or database connected to the Sites; (e) attack the Sites via a denial-of-service attack or a distributed denial-of-service attack; or (f) otherwise attempt to interfere with the proper working of the Sites.

Additionally, you may not use our services to compete with us, to build a similar or competitive service, or to copy any features, functions, or graphics of our Sites. You may not reverse engineer, decompile, or disassemble any portion of our services or attempt to discover any source code or underlying algorithms.

7. Intellectual Property Rights

The Sites and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Dashspace, its licensors, or other providers of such material and are protected by French and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Sites for your personal or internal business use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Sites, except as follows: (a) your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials; (b) you may store files that are automatically cached by your web browser for display enhancement purposes; (c) you may print or download one copy of a reasonable number of pages of the Sites for your own personal or internal business use and not for further reproduction, publication, or distribution.

You must not access or use for any commercial purposes any part of the Sites or any services or materials available through the Sites unless specifically authorized by us in writing. If you wish to make any use of material on the Sites other than that set out in this section, please address your request to: support@dashspace.space.

8. Privacy and Data Protection

Your use of our Sites and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Sites, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

We implement appropriate technical and organizational measures to ensure the security of your personal data. However, you acknowledge that no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security of your data.

9. Disclaimer of Warranties

The information on the Sites is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Dashspace disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Sites will function uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; that the Sites are free of viruses or other harmful components; or that the results of using the Sites will meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

10. Limitation of Liability

In no event will Dashspace, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Sites, any websites linked to them, any content on the Sites or such other websites, or any services obtained through the Sites or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

The foregoing does not affect any liability that cannot be excluded or limited under applicable law. In jurisdictions where limitations of liability are not permitted, our liability shall be limited to the greatest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Dashspace, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Sites, including, but not limited to, your User Contributions, any use of the Sites' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Sites.

12. Termination

We may terminate or suspend your account and bar access to the Sites immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Sites and cancel your subscription through your account settings.

Upon termination, your right to use the Sites will immediately cease. If you wish to terminate your account, you may do so by following the instructions on the Sites. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any dispute arising out of or relating to these Terms or the Sites shall be subject to the exclusive jurisdiction of the courts of Paris, France. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Sites after any revisions become effective, you agree to be bound by the revised terms.
